Redevelopment, Real Estate and Affordable Housing

Overview

Since the founding of the firm, Meyers Nave has assisted numerous redevelopment agencies, municipalities and other public agencies with all aspects of real property acquisition, development and disposition. Serving as general or special counsel to dozens of California redevelopment agencies, we assist with the adoption and amendment of redevelopment plans; compliance with the requirements of Community Redevelopment Law; the implementation of redevelopment projects; and the development and implementation of affordable housing policies and programs, including the development and implementation of first-time homebuyer and inclusionary housing programs.

On a regular basis, we provide our clients with legislative and case law updates. We also conduct “Redevelopment 101” training workshops for elected officials, department heads and staff, and frequently offer seminars on legal issues and practice pointers. For the past five years, we have served as faculty for the California Redevelopment Association (CRA) Redevelopment Institutes, providing comprehensive training on “Basic and Advanced Affordable Housing” and “Critical Elements of the OPA/DDA.”

At the request of the League of California Cities, we have prepared amicus briefs, including support of CRA’s appeal of the Supplemental Revenue Augmentation Funds (SERAF) decision.

Subpractices

  • Our attorneys have negotiated and prepared documentation for dozens of affordable housing projects that use multiple sources of financing, including tax-exempt bonds, low-income housing tax credits, redevelopment gap financing, State IIG, TOD, and MHP funds and federal funds provided through Section 8, Section 202, and the HOME, CDBG, and NSP programs.

  • We negotiate and prepare owner participation agreements, disposition and development agreements, purchase and sale agreements, ground leases, commercial leases, affordable housing regulatory agreements, and loan and financing documents for commercial development and affordable housing transactions.

  • We provide ongoing advice to redevelopment agency staff, management and elected officials on matters regarding compliance with California Community Redevelopment Law on such issues as the use of tax increment funds for public improvements, compliance with notice, hearing and reporting requirements, the use of housing set-aside funds, and relocation and replacement housing obligations.

  • We advise redevelopment agencies in connection with the adoption of redevelopment plans for new project areas and the amendment of redevelopment plans to add territory, extend eminent domain authority, extend time and financial limits and effectuate fiscal mergers.
